Hatopya News Website Service Agreement

These terms govern free news infrastructure. Sending an application alone does not launch a website or paid service. Optional paid services require separate written confirmation.
1. Parties and authority
The provider is Cen Medya Limited Şirketi, operating as Hatopya; contact details appear below. The user is the individual or entity identified in the application and its authorised representative. The applicant confirms ownership or authority and accurate information. Domain ownership or representation may be verified separately.
2. Free access
News software, licence, standard setup, hosting, server and CDN are free, without a paid software plan or trial expiry, while lawful-use and regular-publication obligations are met. Neither editorial management nor a mobile-app purchase is a condition of free software access.
3. Domain ownership
The user owns the domain and normally pays purchase and renewal costs. If Hatopya registers it on the user’s behalf, the user remains registrant. Any domain subsidy or promotion is specified beforehand in writing. Costs promised as free cannot later become debt. Only separately pre-approved, documented third-party expenses may be charged. Transfers follow registrar rules; the user’s domain, brand or publication identity cannot be transferred to another person without separate express written consent.
4. Intellectual property
Software, source code and platform intellectual property belong to Cen Medya Limited Şirketi. Access is a service licence for the agreement’s term, not a transfer of source code or the whole platform database. Users retain rights in their own or lawfully controlled content. Third-party works and agency material remain subject to licences. Limited technical storage/publication rights do not transfer content ownership to Hatopya.
5. Setup and operations
Under the setup plan Hatopya assists with DNS/Cloudflare, suitable R2/CDN connections and branding. The user supplies necessary domain and external-account permissions. Security, maintenance, backups, reasonable technical support and panel guidance form part of operations. Maintenance or third-party outages are communicated where possible. Uninterrupted availability or a fixed backup interval is not guaranteed; mandatory liability rules remain applicable.
6. Search, analytics and advertising
Hatopya assists with technical SEO, sitemaps and suitable Search Console/Google News processes. Google’s current automated assessments prevent any guarantee of acceptance, traffic or ranking. Analytics and advertising integrations require the user’s request and applicable privacy/permission steps; users receive access to their external accounts. Accepting these terms is not consent to tracking cookies or marketing.
7. Regular publication
The normal commitment is an average of at least two new, relevant articles per day over a month. A different frequency may be agreed in writing. Illness, force majeure, outages and reasonable notified editorial breaks are considered. Editorial-service responsibilities are separately defined. Failure does not create a paid software plan or automatic fee; notice and remedy provisions apply.
8. Content and rights
Users maintain accurate imprint/contact information and responsibility for accuracy, legality and usage rights. Attribution or rewriting one third of an article does not itself provide copyright permission; valid licences, agency contracts or statutory exceptions are needed. Illegal gambling advertising, promotion of terrorism, child sexual abuse, unlawful sexual material, hate/violence incitement, defamation and privacy violations are prohibited. Lawful reporting on these subjects is not inherently prohibited. Corrections and official orders follow applicable law.
9. Advertising and shared content
Users may use lawful advertising services and retain their revenue. Cooperation may reserve one sidebar advertising placement and a small shared-content area that does not disrupt the homepage. Position, content type, limited frequency and approvals are defined clearly in writing during setup. No unlimited publishing or unrestricted authority in the user’s name is granted. Promotions are labelled and relevant and lawful; other placements remain under user control.
10. Optional paid services
Management and editorial service costs 600 USD plus VAT monthly. A standalone mobile app costs 200 USD plus VAT yearly. The app for that publication is free while management/editorial service is active. Afterwards, paid app continuation requires separate express approval; no automatic charge starts. Scope, approvals, app/store requirements, start, term, taxes, applicable payment currency/exchange rate and invoicing are confirmed separately in writing before ordering. Prices exclude VAT; these terms are not a payment instruction. Credits/refunds for existing periods and any mandatory consumer rights are addressed separately.
11. Security and fair use
Users protect access and report unauthorised use. Accessing another publication’s information, bypassing security and harmful automation are prohibited. Unlicensed bulk copying or excessive automated load may lead to proportionate, explained rate/quota limits, notified beforehand where possible. Limits do not create paid software access and last only as necessary.
12. Data and communications
Application and service information is processed for the purposes and legal grounds stated in the separate privacy notice. These terms are not blanket data-processing or marketing consent. Notices use the registered email and, if separately verified, WhatsApp, subject to applicable evidence rules. Users keep contact details current. A Turkish national identity number is not mandatory for this online application.
13. Notice, suspension and termination
Ordinary breaches require written notice and at least 15 days to remedy; justified extensions may be considered. Unremedied material breach may lead to proportionate suspension or termination. Official orders, clear illegality or serious security threats may require immediate necessary action, with reasons subsequently given where lawful. Users may terminate by written notice. No retrospective free-software licence/hosting debt arises, and termination never authorises transfer of the user’s domain or content to others.
14. Export and changes
Users may request secure export of content they own and may transfer in a commonly readable format; requests remain available for at least 30 days after termination notice. Third-party licences and legal retention/removal duties apply. Other publications’ information, platform keys and source code are excluded. Material changes are notified in a durably accessible text at least 30 days ahead, with separate acceptance where required. Changes cannot convert existing free access into a paid software plan or create retrospective debt.
15. Disputes and acceptance
Turkish law applies, subject to mandatory consumer information, withdrawal, refund and jurisdiction rights where relevant. Mandatory competence rules and rights are not waived. Parties first seek written resolution. Explicit application acceptance records document language/version/hash and server time; it is not presented as a qualified electronic signature. Paid services require separate scope and price confirmation.
